GenerativeIDE – Terms of Service

Welcome, and thank you for your interest in GenerativeIDE (“GenerativeIDE,” “we,” “us,” or “our”), an offline-first AI-powered development environment.

These Terms of Service (“Terms”) govern your access to and use of GenerativeIDE’s software, desktop applications, command-line tools, plugins, documentation, and related services (collectively, the “Service”). By using the Service, you agree to these Terms.

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.


1. Access and Use

1.1 Provision of Access

GenerativeIDE provides AI-assisted developer tools designed to help users write, understand, refactor, and manage code efficiently. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service.

1.2 Content

You may provide inputs to the Service, including code, prompts, files, and documentation (“Inputs”). The Service may generate code or other outputs based on your Inputs (“Outputs”). Inputs and Outputs together are referred to as “Content”.

You retain all rights to your Inputs. Subject to applicable law, you also own the Outputs generated for you.

1.3 Data Sharing & Explicit Opt-In

By default, GenerativeIDE does not collect, transmit, or share your Inputs or Outputs.

You may optionally opt in to data sharing for specific purposes, such as:

  • Improving GenerativeIDE features
  • Debugging issues you explicitly report
  • Participating in research or beta programs

Any such opt-in will:

  • Be explicit, affirmative, and configurable
  • Clearly disclose what data is shared and why
  • Be revocable at any time via settings

1.4 Model Training

GenerativeIDE does not use Content to train AI models, nor allow third parties to do so.

1.5 Limitations of AI Outputs

You acknowledge that Outputs are generated automatically and may:

  • Contain errors or misleading information
  • Be similar to outputs generated for other users
  • Be unsuitable for production use without review

You are solely responsible for reviewing, testing, and validating Outputs before use.

1.6 Use Restrictions

Except to the extent prohibited by law, you may not:

  • Reverse engineer, decompile, or disassemble the Service
  • Use the Service to develop or train competing AI models
  • Perform model extraction or benchmark exploitation
  • Probe, scan, or attempt to breach the Service
  • Use the Service in violation of applicable laws or third-party rights

2. Offline-First Operation

GenerativeIDE is designed to operate primarily offline. By default:

  • Source code remains on your local machine
  • No Inputs or Outputs are transmitted to our servers

Optional online features (if enabled) will clearly disclose what data is transmitted and for what purpose.


3. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.


4. Account Registration

Certain features may require account registration. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.


5. Payment and Subscriptions

Some features may require payment. Fees are non-refundable except as required by law. Subscriptions renew automatically unless canceled prior to renewal.


6. Beta Features

Beta or experimental features are provided “as is” and may be discontinued at any time without notice. Use at your own risk.


7. Intellectual Property

The Service, including all software, models, and trademarks, is owned by GenerativeIDE or its licensors. No rights are granted except as expressly stated in these Terms.


8. Privacy

Please review our Privacy Policy for information on how we handle data. These Terms incorporate the Privacy Policy by reference.


9. Termination

We may suspend or terminate access to the Service if you violate these Terms or misuse the Service. Upon termination, your license ends immediately.


10. Disclaimer of Warranties

THE SERVICE AND OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.


11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GENERATIVEIDE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE PREVIOUS SIX (6) MONTHS OR $100, WHICHEVER IS GREATER.


12. Indemnification

You agree to indemnify and hold harmless GenerativeIDE from claims arising out of your misuse of the Service or violation of these Terms.


13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States and the State of Texas, without regard to conflict-of-law principles. Disputes shall be resolved through binding arbitration or small-claims court where applicable.


14. Changes to Terms

We may modify these Terms from time to time. Continued use of the Service constitutes acceptance of the updated Terms.
